National Residence and Teleworking visa (Digital Nomad visa)

This visa is for any foreigner planning to live in Spain as a resident, working remotely for a Company or an employer (or self-employed) located outside of the Spanish national territory, and using exclusively computer telematics and telecommunication media and systems.

When the applicant is self-employed, he/she can also work for a company located in Spain, as long as the percentage of this particular work doesn´t exceed 20% of the total amount of his/her professional activity.

The applicant must have an undergraduate or postgraduate degree from a University, College or Business School of prestige, or have at least 3 years of work experience in his/her current field of activity.

The following family members may also obtain the visa:

  • The spouse or unmarried partner.
  • Dependent children and dependent relatives in the ascending line who form part of the family unit.

Please note that the applicant must apply for a NIE number prior to visa application. Please check on the website of the Embassy of Spain the relevant procedure to apply for a NIE number.

Required documents for the worker and their family members

Official foreign documents must be legalized and, where applicable, must be submitted together with a sworn translation into Spanish

1. National visa application form. Each applicant, or his/her representative, must fill and sign a visa application form.

2. Photography. A recent, passport-size, colour photograph, taken against a light background, facing forward, without dark or reflective glasses, or any garments concealing the oval of the face.

3. Passport with a minimum validity of 1 year and containing two blank pages. Original and a photocopy of the page or pages of the passport that contain biometric data. Passports issued more than 10 years ago will not be accepted.

4. Criminal record certificate. Applicants of legal age who apply for a visa must submit the original and a copy of the criminal record certificate(s) issued by his/her country or countries of residence for the past 2 years. This certificate must have been issued within the 6 months period before the visa application is submitted, unless the certificate itself specifies a longer expiration. Additionally, the applicant will submit a responsible declaration confirming the absence of criminal records for the last five years.

5. Health insurance. Original and a copy of the certificate accrediting the public or private health insurance contracted with an insurance entity authorized to operate in Spain. The insurance policy must cover all the risks insured by Spain's public health system. Travel insurances will not be accepted.

6. Certification of working for at least 3 months (before the visa application is submitted) for a foreign Company. To this end, the applicant will submit a certificate, issued by the company and stating the following:

  • If the applicant is an employee: duration of the contract, explicit consent to work remotely in Spain and salary details.
  • If the applicant is self-employed/entrepreneur: duration of the contract, the terms and conditions to work remotely in Spain.

7. Certificate issued by the Commercial Register (or any analogous institution in the country) showing the company’s incorporation date and its type of activity.

8. Affidavit showing the commitment to comply with all obligations related to Social Security matters, before the beginning of the professional or working activity. In the event of non-coverage by means of an international standard for the coordination of social security systems and paid employment, proof of the registration of the company in social security must be presented.

9. A certificate proving the company and employee´s registration with Spanish Social Security. If the applicant is self-employed, he/she must provide a certificate of having applied for registration with RETA (Régimen de Trabajadores Autónomos de la Seguridad Social española).

10. Supporting documents accrediting the existence of enough financial means to cover the expenses of the applicant and members of their family, according to the following amounts:

  • Visa holders and residence authorizations: an amount which monthly accounts for 200% of the Spanish minimum wage (1.184 euros) or 2.368 euros.
  • Family units of two people, including the applicant and the reunited person: at least 75% of the Spanish minimum wage. An additional 25% of the Spanish minimum wage will be required for every additional member.

The ownership, availability and legality of funds must be accredited. To justify the afore-mentioned amounts, any of the following documents may be employed:

  • Work contract.
  • Binding job offer.
  • A commercial contract in the case of a professional relationship.

11. Copy of University degree or documentation accrediting a minimum of three years of professional experience.

12. Proof of residence in the consular district. (Kenya, Uganda or Somalia). Persons of nationalities other than Kenyan, Ugandan or Somalian must submit a photocopy of their residence permit in one of these three countries.

13. Payment of the visa fee. Visa fee payment is compulsory and has to be made at the same time when submitting a visa application. The fee has to be paid in local currency and it is subject to regular changes due to the currency fluctuations. Please check the list of fees on the website of the Embassy of Spain.

SPECIFIC REQUIREMNTS FOR FAMILY MEMBERS:

  • Documents proving family relationship with the worker: birth or marriage certificates issued by the civil registry, certificate of registration as an unmarried couple or any other document proving that the relationship is an unregistered partnership.
  • In the case of adult children, documents proving their financial dependence and civil status.
  • In the case of relatives in the ascending line, documents proving they are in the investor's care.

PROCEDURE

The Embassy of Spain is competent to accept visa applications from applicants residing in the consular district.

Who can apply for a visa: Visa applications must be submitted in person by the applicant or by one of their parents if the applicant is a minor. They may also be submitted through a duly accredited representative.

Proof of receipt: BLS will provide the applicant with proof of receipt of the application with a code that enables them to check the status of the dossier

Rectifying the application: The Embassy of Spain (consular section) may ask the applicant to submit any missing documents, or to provide additional documents or data that are necessary for a decision regarding the application. The applicant may also be called in for a personal interview.

Decision deadline: The legal term for reaching a decision is 10 days, but this term may be extended when an interview or additional documents are requested.

Collecting the visa: Visas must be collected in person by the applicant or by their representative within 1 month, counted from the day after the date of notification. The Consular Office will inform the applicant regarding the procedure for the return of the passport and any other original documentation.

Visa refusal: Visa refusals will always be notified in writing, setting forth the grounds on which the decision adopted is based.

Appeals: If a visa is refused, the applicant may submit an appeal for reconsideration to the Embassy of Spain (consular section) within 1 month of the day following the date on which notification of the refusal is received. An application for judicial review may also be filed with the High Court of Justice of Madrid within the 2-month period beginning the day after the date on which the applicant receives notification of the visa refusal or of the dismissal of the reconsideration appeal.

Validity of the visa: This visa will be valid for a maximum of 1 year or less (depending of the authorization granted to live and work in Spain). The visa accredits legal residence in Spain. Although not required, it is possible to apply for a Foreigner Identity Card, TIE, from the Foreign Nationals' Office or the corresponding Police Station.

SWORN TRANSLATIONS AND LEGALISATIONS

The legalization of documents shall include all the signatures of the signatures of the official documents. Final legalization of foreign documents is to be carried out at the Embassy of Spain. Legalization service is open on Thursdays from 9 AM to 1 PM and not subject to prior appointment. However if the applicant wishes to get legalized a high number of documents or if the legalization of documents is urgent, please contact emb.nairobi.vis@maec.es in advance. Also, please note that legalization of documents is subject to the payment of a fee. Please check the list of fees on the website of the Embassy of Spain.

Note: We regret we cannot accept photographs that do not meet these requirements

Please provide one recent photograph (not more than 6 months old) of yourself, which should not have been used previously in the passport. The photograph should be in colour and:

  • Two recent colour passports, size of photographs(45mm x 35mm) full face and taken against a white background so that features are distinguishable and contrast against the background.
  • It must be clear and show the face focused.
  • Printed on normal photographic paper (camera print).
  • Full face, non-smiling [without sunglasses, a hat/cap or other head covering, unless the applicant wears such items because of their religious belief or ethnic background]
  • Please stick the Photograph on the Visa Application Form.
