Residence and Employment Work Visa

Visa for people aged 16 and over who wish to work as employees in Spain (with a work contract and an Autorización de residencia y trabajo por cuenta ajena issued by the competent Authority in Spain). This visa covers seasonal work activities.

Official foreign documents must be legalized and, where applicable, must be submitted together with a sworn translation into Spanish.

1. National visa application form. Each applicant must complete and sign a visa application, filling in each of its sections. If the applicant is a minor, one of their parents or a duly accredited representative must sign the application.

2. Photograph. A recent, passport-size, colour photograph, taken against a light background, facing forward, without dark or reflective glasses, or any garments concealing the oval of the face.

3. Passport with a minimum validity of 1 year and containing two blank pages. Original and a photocopy of the page or pages of the passport that contain biometric data. Passports issued more than 10 years ago will not be accepted.

4. Copy of the autorización de residencia y trabajo por cuenta ajena issued by the compentent Authority in Spain. The visa application must be submitted within one month from the notification to the employer of the autorización.

5. Criminal record check certificate. Applicants of legal age must submit the original and a copy of the criminal record check certificate(s) issued by their country or countries of residence for the past 5 years. This certificate must have been issued within the 3 months period before the visa application is submitted, unless the certificate itself specifies a longer expiration.

6. Medical certificate. All applicants must submit original and a copy of a medical certificate accrediting that they do not suffer from any disease that could cause serious repercussions for public health pursuant to the 2005 International Health Regulations. This certificate must have been issued within the 3 months period before the visa application is submitte.

7. Proof of residence in the consular district. (Kenya, Uganda or Somalia). Persons of nationalities other than Kenyan, Ugandan or Somalian must submit a photocopy of their residence permit in one of these three countries.

9. Proof of the representative's identity and capacity. If the applicant is a minor, it will be necessary to submit copies of the identity document or passport of one of their parents, as well as of the document constituting proof of kinship.

10. Payment of the visa fee. Visa fee payment is compulsory and has to be made at the same time when submitting a visa application. The fee has to be paid in local currency and it is subject to regular changes due to the currency fluctuations. Please check the list of fees on the website of the Embassy of Spain.

Procedure

The Embassy of Spain (consular section) is competent to accept visa applications from individuals residing in the consular district.

  • Who can apply for a visa: The visa application must be submitted in person by the applicant, or by one of their parents if they are a minor. It may also be submitted through a duly accredited representative.

  • Proof of receipt: BLS will provide the applicant with proof of receipt of the application with a code that enables them to check the status of the dossier.
  • Rectifying the application: The Embassy of Spain (consular section) may ask the applicant to submit any missing documents, or to provide additional documents or data that are necessary for a decision regarding the application. The applicant may also be called in for a personal interview.
  • Decision period: The legal period for reaching a decision is 1 month as of the day after the submission date of the application, but this period may be extended when additional documents are requested or the applicant is called in for an interview.
  • Collecting the visa: The visa must be collected in person by the applicant or by their representative within a maximum period of 1 month, counted as of the day after the date on which the favourable decision is notified. The Embassy of Spain (consular section) will inform the applicant regarding the procedure for the return of the passport and any other original documentation.
  • Visa refusal: Visa refusals will always be notified in writing, setting forth the grounds on which the decision adopted was based.
  • Appeals: If a visa is refused, the applicant may submit an appeal for reconsideration to the Embassy of Spain (consular section) within 1 month of the day following the date on which notification of the refusal is received. An application for judicial review may also be filed with the High Court of Justice of Madrid within the 2-month period beginning the day after the date on which the applicant receives notification of the visa refusal or of the dismissal of the reconsideration appeal.

Validity period of the visa: If the duration of the initial Autorización de residencia y trabajo por cuenta ajena is less than 6 months, the visa may be valid for up until 180 days. For longer duration, the visa will be valid for 365 days. Once in Spain, the worker must register with the Social Security system before beginning their work activity and apply for a Foreigner Identity Card (TIE) at the Foreign Nationals' Office or the corresponding police station, within 1 month from their registration with the Social Security system. If the work contract is for seasonal work, the visa will be valid for the entire period for which the applicant is authorized to reside and work in Spain, which will not be more than 270 days, and it will not be necessary to apply for a Foreigner Identity Card upon arriving in Spain.

SWORN TRANSLATIONS AND LEGALISATIONS

Please check the list of sworn translators-interpreters on the website of the Embassy of Spain.

The legalization of documents shall include all the signatures of the signatures of the official documents. Final legalization of foreign documents is to be carried out at the Embassy of Spain. Legalization service is open on Thursdays from 9 AM to 1 PM and not subject to prior appointment. However if the applicant wishes to get legalized a high number of documents or if the legalization of documents is urgent, please contact emb.nairobi.vis@maec.es in advance. Also, please note that legalization of documents is subject to the payment of a fee. Please check the list of fees on the website of the Embassy of Spain.

Note: We regret we cannot accept photographs that do not meet these requirements

Please provide one recent photograph (not more than 6 months old) of yourself, which should not have been used previously in the passport. The photograph should be in colour and:

  • Two recent colour passports, size of photographs(45mm x 35mm) full face and taken against a white background so that features are distinguishable and contrast against the background.
  • It must be clear and show the face focused.
  • Printed on normal photographic paper (camera print).
  • Full face, non-smiling [without sunglasses, a hat/cap or other head covering, unless the applicant wears such items because of their religious belief or ethnic background]
  • Please stick the Photograph on the Visa Application Form.
